These Terms and Conditions of Sale (hereinafter “Terms”) govern the purchase of products on the kiding.it website, managed by KIDING SRL. Before placing an order, please read these Terms carefully. By completing an order, you declare that you have read, understood, and fully accepted them.

2. Scope of Application

These Terms apply to all purchases made by consumers (natural persons acting for purposes unrelated to their entrepreneurial, commercial, artisan, or professional activity) and by professional operators through the kiding.it website. "Consumer" means as defined by Article 3 of Legislative Decree 206/2005 (Consumer Code).

KIDING SRL reserves the right to modify these Terms at any time. Modifications apply to orders placed after the publication date of the updated version.

3. Products and Prices

The products available on kiding.it are described with their technical characteristics, materials, and images. Images are for illustrative purposes and may differ slightly from the actual product due to photographic rendering.

Prices are expressed in Euros and include applicable VAT. KIDING SRL reserves the right to change prices at any time, it being understood that the buyer will be charged the price indicated at the time of order confirmation.

In case of an obvious error in the price (e.g., a clearly incorrect price due to a technical glitch), KIDING SRL reserves the right to cancel the order by promptly notifying the customer.

4. Purchase Process and Contract Formation

The purchase process on kiding.it takes place as follows:

The user selects the products and adds them to the cart.
Proceeds to checkout by entering shipping and billing information.
Chooses the payment method and completes the order.
Receives an order confirmation email, which constitutes acceptance of the purchase proposal.

The sales contract is considered concluded when KIDING SRL sends the order confirmation via email. KIDING SRL reserves the right not to accept orders in case of product unavailability, payment anomalies, or other justified reasons, by promptly notifying the customer and fully refunding any amount already paid.

Once an order has been placed, no changes or cancellations can be made. If necessary, please contact us promptly at hello@kiding.it: we will evaluate each case individually, depending on the order processing status.

5. Payments

Kiding.it accepts the following payment methods:

Credit and debit card (Visa, Mastercard, American Express)
Apple Pay and Google Pay
PayPal
Other methods potentially activated via Shopify Payments

All payments are managed securely via Shopify Payments, a PCI-DSS Level 1 certified platform. KIDING SRL does not have access to the buyer's credit card data, which are processed exclusively by the payment provider.

Payment is charged at the time of order confirmation. In case of failed payment authorization, the order will not be processed, and the customer will be informed via email.

6. Shipping and Delivery

Shipments are governed by the Shipping Information available on kiding.it, which forms an integral part of these Terms. In summary:

Order processing: within 1 business day from Monday to Friday.
Italy delivery: 24–72 business hours. Couriers: GLS, BRT. Cost: €6.00 (free for orders ≥ €50).
EU delivery: 48–72 business hours. Courier: DHL Express. Cost: €10.00 (free for orders ≥ €50).
Express Italy upon request: contact hello@kiding.it before ordering.

Delivery times are estimated and not guaranteed. KIDING SRL is not responsible for delays attributable to couriers, force majeure, or peak periods.

7. Right of Withdrawal and Returns

The consumer has the right to withdraw from the contract within 14 days of receiving the product, without needing to provide reasons. Returns are free. The complete procedure is described in the Returns and Refunds Information available on kiding.it, which forms an integral part of these Terms.

The refund will be issued within 14 days of receipt of the returned item, after verifying the product's condition, using the same payment method used for the purchase.

The right of withdrawal does not apply to personalized products or sealed products for hygienic reasons that have been opened after delivery (Art. 59 of Legislative Decree 206/2005).

8. Legal Guarantee of Conformity

All products are covered by a 2-year Legal Guarantee of Conformity from the date of delivery, in accordance with Legislative Decree 206/2005 as amended by Legislative Decree 170/2021. The full procedure and available remedies are described in the Legal Guarantee Information available on kiding.it.

9. Liability and Limitations

KIDING SRL is not responsible for:

Indirect, consequential damages or loss of profit resulting from the use of products outside of the instructions for use.
Delivery delays attributable to couriers or force majeure (extreme weather events, strikes, pandemics, natural disasters).
Temporary malfunctions of the kiding.it website due to technical reasons or maintenance.
Content of third-party websites accessible via links on kiding.it.

KIDING SRL's liability towards the consumer is in any case limited to the value of the purchased product, except in cases of willful misconduct or gross negligence.

10. Intellectual Property

All content on kiding.it — texts, images, logos, graphics, product names, trademarks, and any other material — are the exclusive property of KIDING SRL or used under license. Any reproduction, distribution, or commercial use is prohibited without prior written authorization from KIDING SRL.

The Kiding® brand and its logo are registered trademarks of KIDING SRL. Unauthorized use constitutes a violation of intellectual property rights.

11. Privacy and Data Processing

The processing of personal data collected during the purchase phase is governed by the Privacy Policy available on kiding.it, drafted in accordance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003. By completing an order, the buyer declares to have read the Privacy Policy.

12. Dispute Resolution

These Terms are governed by Italian law. For disputes with consumers, the provisions of Legislative Decree 206/2005 (Consumer Code) apply.

Consumers residing in the EU have the right to use the European Commission's ODR (Online Dispute Resolution) platform for out-of-court dispute resolution: ec.europa.eu/consumers/odr.

Alternatively, consumers may contact the competent mediation and conciliation bodies pursuant to Legislative Decree 28/2010.

For disputes with professional operators, the Court of Forlì-Cesena has exclusive jurisdiction.

13. Amendments to the Terms

KIDING SRL reserves the right to amend these Terms at any time. The updated version is always available on kiding.it with the date of the last modification indicated. Amendments do not apply to orders already confirmed.
